Responsibility of Abandoned Child’s Expenditures: A Study of Juristic Approaches

Abstract

Abandoned child is a neglected figure of any human society and it is only due to absence of any responsible person to care such child. This term is not specified for the illegitimate child only but it also covers the children thrown due to poverty fear, unavailability of livelihood means, left alone due to natural disaster or human wars. Islam does not allow the society at large to leave such children helpless. This research paper is a study of juristic approaches regarding the responsibility of abandoned child’s expenditures. This discussion will explore the persons liable to manage such expenditures and also will mention the limits and nature of the expenditures. Three main approaches regarding the liability of the expenditures have been discussed in detail. First of all the needs of such child will be satisfied from his own wealth if available then it will be converted to Muslim treasury, head of Islamic state and after all to the whole Muslim community at large, according to three different juristic approaches. If the head of state appoints any person to look after such child’s matters and he spends his money for this purpose, will it be considered the loan, liable to be returned, or it will be considered the charity from such caretaker? Different Juristic approaches along with their arguments have been discussed in detail in this regard. The debate concludes with result of the majority opinion that, first of all needs of such child will be satisfied from the Muslim treasury and if its funds are insufficient for his needs then any well off person of the society will bear the expenditures preferably on charity basis and if not capable to  afford, then on loan basis. Food, clothing, residence, health, necessary travel and education etc are declared the major expenditures to be provided and it will be according to the need of time, place, and society and also according to the family position of the responsible belongs to. This study is an effort to discuss the Islamic teachings about the satisfaction of daily needs of this neglected class of the society so that they may lead their respectable life.
